I've yet to see this 'universal background check 'defined. The people proposing it obviously never bought a weapon and filled out a form 4473. And as for the statement that 40% of gun sales are unregulated, where is the data to support that? Even if private sales comprise a small amount of total gun sales, how would enacting a law change that. The black market wouldn't suddenly cease to exist if such a law existed, criminals aren't going to suddenly become law abiding citizens.
 
Truth is that since backpage closed down private sale is all but dead,
far as I'm concerned
The GAO conducted a series of offers to purchase weapons at the request of 3 senators who claimed as many as 15k unregulated sales were made each year. The GAO was turned down by sellers 100% of the time. Probably will never see the report hit the newspapers.
